It may happen that a manager is not aware of the problems of employees. They have an employment contract and therefore the staff must work. So it’s not that simple! Some managers miss the point completely, causing the situation to worsen. Threatening with dismissal is also not an option, because this is not permitted by law. An employer is always wise to have an internal contact person where employee problems can be discussed openly. This allows problems to be identified at an early stage before they worsen. In addition, a problem case can be addressed through registration, so that any problems can be resolved.
The Expansion of the Obligation to Continue Payment of Wages in the Event of Illness Act
The problem for the employer is actually that the WULBZ is included in labor law. This law states that employers must continue to pay seventy percent of the last earned wage to a sick employee for up to two years. This can therefore be quite costly in the event of long-term absence. In addition, a sick employee may never be dismissed due to his illness during those two years. In other words, the interests of the employees are well regulated and the employer is therefore wise to raise problems quickly.

Dismissal due to illness is not allowed
The question is often asked whether a sick employee can be dismissed if he or she is at home. This is indeed not allowed if the reason concerns the illness or absenteeism itself. The employee is therefore in a weakened situation, possibly on doctor’s advice and has difficulty defending himself. In order to be able to provide an income, one cannot be fired. Of course, there are exceptions to this rule, namely the following:
- the sick employee has done something inexcusable or has made a serious mistake consciously or unconsciously. The urgent reason may lead to immediate dismissal. Please note that the reason must be thoroughly demonstrated, and there must be no relationship with the disease as the reason;
- the employer goes bankrupt, leaving everyone collectively on the street;
- the employee resigns himself.
Apart from these reasons, an employee cannot and may not be dismissed during the illness.
